Summary Only Motoring Offences

A summary only offence is a type of criminal offence that can only be dealt with in the Magistrates' Court and does not require a jury trial. Some of these offences may be resolved in one hearing. ​​​​​​​​​​

​​Cases in this category typically include:

  • Speeding

  • Drink or Drug Driving

  • Failure to Provide a Specimen

  • Using a Mobile Phone While Driving

  • Driving Without Due Care and Attention

  • Failure to Stop or Report an Accident

  • Failing to Give Information as to the Identity of a Driver

  • Totting Up Disqualifications

  • Driving Without Insurance

  • Tachograph Offences​

Our motoring offences team will provide you with expert representation in the Magistrates’ Court. We offer both fixed fees and hourly rates, allowing you to choose the option that best suits your needs.​

What’s included in a Fixed Fee?

  • An initial consultation with you to obtain the details of your case

  • Considering the strength of the evidence in your case

  • Advising you on your plea and the potential outcomes in court

  • Advising you on the court procedure

  • Representation at your hearing in the Magistrates’ Court

  • Discussing the outcome and any next steps with you post-hearing​

  • Our travelling time and costs

Some services are not included in a Fixed Fee. These could be:​

  • Instructing expert witnesses or counsel

  • Collecting witness statements

  • Advice and representation at subsequent and/or additional hearings.

  • Advice or representation for any appeals

The total cost of your case may vary depending on several factors, including how many meetings and court appearances are required, whether experts are involved in the case, how complex the evidence is, and where the court is located. It's important to note that cases proceeding to the Crown Court would not be covered by the fixed fee and would incur additional costs.

 

For more complex cases, or where an hourly rate is more appropriate, we also offer clearly structured fees.​

Additional fees we incur on your behalf, sometimes called Disbursements, will be charged separately. These can include:​​​

  • Instructing Counsel or expert witnesses, or commissioning expert reports

  • Printing, Copying, or Postage charges, or Transcription or Translation fees

  • Travel costs, or mileage at 45p per mile
