Careless driving is one of the most commonly prosecuted motoring offences. It applies where a driver’s standard of driving falls below that expected of a competent and careful driver.

How is careless driving defined?
Under section 3 of the Road Traffic Act 1988, a person commits the offence if they drive without due care and attention or without reasonable consideration for other road users.
The legal test is objective. The court asks whether the driving fell below the standard expected of a careful and competent driver.
How driving behaviour can be considered as careless driving?
Careless driving can arise from routine road situations, including:

tailgating other road users

failing to signal or check mirrors

being distracted by in-cab equipment or controls

braking unnecessarily or excessively
Penalties if convicted of careless driving
The court can impose:

fines up to 250% of weekly income

between 3 and 9 penalty points

discretionary disqualification
Cases involving those driving for work, poorly maintained vehicles or where vulnerable road users are put at danger will be considered more serious, increasing the risk and severity of penalties.
