Causing death by careless or inconsiderate driving

A fatal collision does not need to involve extreme driving to result in a criminal charge. Causing death by careless or inconsiderate driving applies where a driver’s standard of driving falls below that expected of a competent and careful driver.

This offence recognises that a momentary lapse can have catastrophic consequences.  Although it carries lower maximum penalties than dangerous driving, the legal, professional and regulatory impact (especially if driving for work) remains significant.

What is causing death by careless driving?

Under section 2B of the Road Traffic Act 1988, the offence is committed where a person causes the death of another by driving without due care and attention or without reasonable consideration for other road users. The distinction is critical:

  • careless driving falls below the expected standard

  • dangerous driving falls far below that standard and is obviously dangerous

 

The prosecution does not need to prove recklessness or intent. A brief error of judgement is sufficient if it results in a fatality.

How these cases arise

Investigations focus on whether the driver’s conduct slipped below the required standard on the lead up to and at the point of impact. Common issues include:

  • distraction inside the vehicle

  • failure to observe a pedestrian, cyclist or motorcyclist

  • misjudging speed or distance

  • poor lane discipline

  • following too closely

  • failing to give way

 

Evidence typically includes collision reconstruction, dashcam or CCTV footage, telematics data, phone records and witness accounts. The central question is whether any carelessness caused or contributed to the death.

What are the potential penalties for causing death by careless driving?

  • Maximum sentence: five years’ imprisonment

  • Mandatory disqualification (minimum 12 months)

  • Discretionary extended driving test before licence restoration

 

Sentence is determined by culpability and harm. For professional drivers, licence loss alone can end employment
